The court dismisses the request for an injunction by the boy band "The Rose" to suspend the active effect of the exclusive contract against the agency.
The agency J&Star Company announced on August 31 that "The Rose" has notified its agency last February that they are currently fighting for the termination of the exclusive contract due to non-payment of settlement fees, broken trust relationships, and the violation of the entire agreement. Still, it was all dismissed by the court.
However, the proceeding with arbitration is currently through the Korea Commercial Arbitration Board, where they want the current situation through procedures between the two parties will be resolved smoothly.
The members of the boy band "The Rose," Kim Woo Sung, Park Dojoon, Lee Hajoon, and Lee Jaehyeong, released a statement after their request was rejected. They explained why they want their contract to be terminated, and they have evidence of their claims, but the agency replied that the group's allegations are wrong.
To suspend the exclusive contract's said effect, "The Rose" filed for an injunction with Seoul Central District Law in March. The listed allegations include the agency's enforcement of an unreasonable schedule and problems regarding their payments, damage of trust, and, more likely, the breach of exclusivity.
The Rose (non-breaching party) has the right to terminate the agreement immediately upon providing written notice of such termination, in which case the effects of termination set forth shall apply. The group has provided the requirements, but unfortunately, the court dismissed the case.
There were no details given by the court, and the court trashed the concern that was raised. The group will continue to seek justice on what the agency has done to them.
